C-16331, afsagt den 10. juni 2024<\/h3>\n<p>M\u00e5nedens afg\u00f8relse vedr\u00f8rer en tvist mellem en underentrepren\u00f8r og en totalentrepren\u00f8r om, hvorvidt de i tilbudslisten angivne enhedspriser var anvendelige p\u00e5 udf\u00f8rte arbejder, herunder om udf\u00f8relse af visse kloakarbejder var mere ressourcekr\u00e6vende, end hvad underentrepren\u00f8ren havde kunne forvente p\u00e5 baggrund af udbudsmaterialet.<\/p>\n<p>\u200d<\/p>\n<p><strong>Resume<\/strong><\/p>\n<p>Totalentrepren\u00f8r (E) og underentrepren\u00f8r (U) indgik den 7. maj 2020 en entrepriseaftale vedr\u00f8rende udf\u00f8relse af en r\u00e5husentreprise, hvor AB 92 var vedtaget.<\/p>\n<p>\u200d<\/p>\n<p>Entreprisesummen var fastlagt til 563.802.000 kr. ekskl. moms, og parterne havde aftalt, at entreprisesummen skulle reguleres efterf\u00f8lgende i forhold til faktiske anvendte m\u00e6ngder, som pr\u00e6ciseret i udbuddet.<\/p>\n<p>\u200d<\/p>\n<p>Projektet blev udbudt, inden projektet var f\u00e6rdigprojekteret, og udbuddet var derfor tilrettelagt s\u00e5dan, at U havde afgivet enhedspriser p\u00e5 m\u00e6ngder, som TE havde angivet i udbudsgrundlagets tilbudsliste. Parterne blev efterf\u00f8lgende uenige om, hvorvidt disse enhedspriser var anvendelige p\u00e5 udf\u00f8rte kloakarbejder.<\/p>\n<p>\u200d<\/p>\n<p>U gjorde g\u00e6ldende, at foruds\u00e6tningerne for de aftalte enhedspriser var v\u00e6sentligt \u00e6ndrede i forhold til udbudsgrundlaget, og at enhedspriserne derfor ikke var bindende for U. TE gjorde modsat g\u00e6ldende, at det udf\u00f8rte arbejde ikke konkret havde skiftet karakter p\u00e5 en s\u00e5dan m\u00e5de, at enhedspriserne ikke var bindende for U.<\/p>\n<p>\u200d<\/p>\n<p>For s\u00e5 vidt angik r\u00f8rledninger fandt voldgiftsretten, at \u201d<em>[\u2026] U har godtgjort, at antallet af forgreninger og b\u00f8jninger er for\u00f8get v\u00e6sentligt per meter afl\u00f8bsledning i forhold til, hvad U m\u00e5tte forvente efter oplysningerne i udbudsgrundlaget og at en s\u00e5dan for\u00f8gelse har medf\u00f8rt en v\u00e6sentlig for\u00f8get kompleksitet, som U har krav p\u00e5 vederl\u00e6ggelse for. U er derfor ikke bundet af de aftalte enhedspriser<\/em>\u201d.<\/p>\n<p>\u200d<\/p>\n<p>Tilsvarende bem\u00e6rkede voldgiftsretten i forhold til trykfaste d\u00e6ksler p\u00e5 pumpebr\u00e6nde, at, \u201d<em>[\u2026] det m\u00e5tte have st\u00e5et TE klart, at U var af den opfattelse, at E havde accepteret valget af br\u00f8nde og trykfaste st\u00e5ld\u00e6klser [\u2026] og at TE derfor ved ikke p\u00e5 et v\u00e6sentligt tidligere tidspunkt at komme med indsigelser ved passivitet har accepteret U\u2019s materialevalg til priser, der afveg fra enhedspriserne<\/em>\u201d.<\/p>\n<p>\u200d<\/p>\n<p>Da der ikke var grundlag for at tilsides\u00e6tte U\u2019s justerede enhedspriser som ubillige, jf. princippet i k\u00f8belovens \u00a7 5, tog voldgiftsretten U\u2019s krav om betaling for hhv. r\u00f8rledninger og trykfaste d\u00e6ksler p\u00e5 pumpebr\u00f8nde til f\u00f8lge.<\/p>\n<p>\u200d<\/p>\n<p><strong>Hvad kan udledes af afg\u00f8relsen?<\/strong><\/p>\n<p>Afg\u00f8relsen viser, at selvom der er aftalt enhedspriser, s\u00e5 kan dette fraviges, hvis det arbejde, som er enhedsprissat, viser sig mere ressourcekr\u00e6vende, end hvad der kunne forventes p\u00e5 baggrund af udbudsmaterialet.<\/p>\n<p>\u200d<\/p>\n<p><strong>\u00d8vrige afg\u00f8relser<\/strong><\/p>\n<p><strong>Mangler<\/strong>\u200d<\/p>\n<p><a href=\"https:\/\/pro.karnovgroup.dk\/b\/documents\/7000964312\">TBB 2024.880\u00a0<\/a>\u2013 sag nr. C-16153<br \/>\nHovedentrepren\u00f8r blev tilpligtet at betale udstedte fakturaer, selvom de n\u00e6gtede dette, under henvisning til mangler ved underentrepren\u00f8rens arbejde.<br \/>\n\u200d<\/p>\n<p><strong>Oph\u00e6velse<\/strong><\/p>\n<p><a href=\"https:\/\/pro.karnovgroup.dk\/b\/documents\/7000964317\">TBB 2024.899<\/a>\u00a0\u2013 sag nr. C-16458<br \/>\nBygherres oph\u00e6velse af entreprisekontrakt var uberettiget, da entrepren\u00f8ren ikke p\u00e5 noget tidspunkt havde v\u00e6ret i ansvarsp\u00e5dragende forsinkelse. Desuden sp\u00f8rgsm\u00e5l om erstatning og mangler.<br \/>\n\u200d<\/p>\n<p>\u200d<\/p>\n<p><strong>Ekstraarbejder<\/strong>\u200d<\/p>\n<p><a href=\"https:\/\/pro.karnovgroup.dk\/b\/documents\/7000964310\">TBB 2024.869\u00a0<\/a>\u2013 sag nr. C-16003<br \/>\nHovedentrepren\u00f8rs krav p\u00e5 betaling for ekstraarbejde blev taget til f\u00f8lge, da bygherre havde godkendt disse p\u00e5 et tidligere m\u00f8de. Det kunne ikke f\u00f8re til et andet resultat, at der i referatet stod, at det var en gensidig betingelse, at udbedring af resterende bel\u00e6gninger p\u00e5 altanbunde skulle udf\u00f8res hurtigst muligt. Desuden sp\u00f8rgsm\u00e5l om mangler og r\u00e5dgiveransvar.<\/p>\n<p><strong>\u200d<\/strong><\/p>\n<p><strong>R\u00e5dgivningsansvar<\/strong>\u200d<\/p>\n<p><a href=\"https:\/\/pro.karnovgroup.dk\/b\/documents\/7000964309\">TBB 2024.850<\/a>\u00a0\u2013 sag nr. C-15432<br \/>\nTotalr\u00e5digiver fundet erstatningsansvarlig for projekteringsfejl ved ventilationsanl\u00e6g, som ikke levede op til de krav, som fremgik af aftalegrundlaget.<\/p>\n<p>\u200d<br \/>\n<a href=\"https:\/\/pro.karnovgroup.dk\/b\/documents\/7000964308\">TBB 2024.838<\/a>\u00a0\u2013 sag nr. C-14766<br \/>\nTotalr\u00e5dgiver p\u00e5lagt ansvar for projekteringsfejl og mangelfuld tidsstyring som f\u00f8lge af manglende udarbejdelse og ajourf\u00f8ring af de i ydelsesbeskrivelsen kr\u00e6vede tidsplaner. Desuden sp\u00f8rgsm\u00e5l om merhonorar.<br \/>\n\u200d<\/p>\n<p><strong>Garanti<\/strong>\u200d<\/p>\n<p><a href=\"https:\/\/pro.karnovgroup.dk\/b\/documents\/7000964318\">TBB 2024.884\u00a0<\/a>\u2013 sag nr. G-3393<br \/>\nTotalentrepren\u00f8r var berettiget til at foretage tr\u00e6k p\u00e5 bygherrens garanti. Desuden sp\u00f8rgsm\u00e5l om ekstraarbejder, dagbod, indeksregulering og renter.<\/p>\n<p>\u200d<br \/>\n<a href=\"https:\/\/pro.karnovgroup.dk\/b\/documents\/7000964316\">TBB 2024.835\u00a0<\/a>\u2013 sag nr. C-16345<br \/>\nEntrepren\u00f8rgaranti var i forbindelse med entrepren\u00f8rens konkurs ikke nedskrevet fra 15 % til 10 %, da anmodningen om dette blev fremsendt, inden stadeforretningen var endelig afsluttet.<\/p>\n<p>\u200d<\/p>\n<h4>Nyheder fra branchen<\/h4>\n<p><strong>M\u00e5nedens fokus: AP Pension udvikler ny ejendom til Team Danmark<\/strong><\/p>\n<p><strong>\u200d<\/strong><br \/>\nAP Ejendomme har indg\u00e5et en aftale med Team Danmark om udviklingen af et nyt domicil, hvor Team Danmark vil kunne tilbyde de danske atleter bedre faciliteter. AP Ejendomme bliver ejer af domicilet, mens Team Danmark bliver langvarig lejer.<\/p>\n<p>\u200d<br \/>\nDet nye domicil vil blive bygget i Br\u00f8ndby, hvorfor Sportsbyen i Br\u00f8ndby Kommune st\u00e5r til at blive udvidet med en bygning p\u00e5 4.000 kvadratmeter fordelt p\u00e5 5 etager.<\/p>\n<p>\u200d<br \/>\nAdm. direkt\u00f8r i AP Ejendomme, Peter Olsson udtaler: \u201d<em>Vi er naturligvis meget glade for, at vi har indg\u00e5et en aftale med Team Danmark, s\u00e5 vi kan v\u00e6re med til at underst\u00f8tte de behov, som Team Danmark har for nye og mere moderne faciliteter.<\/em>\u201d<\/p>\n<p>\u200d<br \/>\nSamtidig er adm. direkt\u00f8r Peter Olsson glad for aftalen, da den lader AP Ejendomme f\u00f8lge deres strategi om at udvide deres portef\u00f8lje med yderligere kontorejendomme.<\/p>\n<p>\u200d<br \/>\nTeam Danmark er ogs\u00e5 glade for aftalen, da de nye faciliteter giver de danske atleter de bedste rammer og betingelser for at kunne pr\u00e6stere p\u00e5 det h\u00f8jest mulige internationale niveau.<\/p>\n<p>\u200d<br \/>\nFormand for Team Danmark, Lars Krarup udtaler: \u201d<em>Med det kommende Team Danmark Hus bliver vores aktiviteter samlet \u00e9t sted. Dermed kommer vi b\u00e5de til at have test- og behandlingsfaciliteter til atleterne, faciliteter til integration mellem forskning og praksis og langt bedre muligheder for, at eksperter kan videndele i domicilet.
