R-59 \u2013 Afsagt den 20. december 2023<\/h3>\n<p>M\u00e5nedens afg\u00f8relse omhandler en tvist mellem en entrepren\u00f8r og en bygherre vedr\u00f8rende godtg\u00f8relse for ekstraordin\u00e6re prisstigninger, hvilket entrepren\u00f8ren ikke fik medhold i, da det ikke var godtgjort, at der forekom prisstigninger p\u00e5 materiale \u201d<em>i f\u00e6rdig form\u201d<\/em>, jf. AB 18 \u00a7 35, stk. 2.<br \/>\n\u200d<\/p>\n<p><strong>Resume<\/strong>\u200d<\/p>\n<p>Den 16. april 2021 indgik entrepren\u00f8r (E) og bygherre (BH) en entrepriseaftale i form af en rammeaftale om bl.a. asfaltbel\u00e6gninger. Parterne havde vedtaget AB 18 \u00a7 35 om ekstraordin\u00e6re reguleringer i entrepriseaftalen.<\/p>\n<p>Der opstod tvist mellem parterne, da E anf\u00f8rte at have ret til godtg\u00f8relse efter AB 18 \u00a7 35, stk. 2, som f\u00f8lge af at priserne p\u00e5 bitumen og naturgas var steget ekstraordin\u00e6rt med henholdsvis 80 % og 400 %.<\/p>\n<p>BH gjorde g\u00e6ldende, at E ikke havde godtgjort ekstraordin\u00e6re prisstigninger p\u00e5 asfalt, som var det materiale, som i f\u00e6rdig form indgik i arbejdet, jf. AB 18 \u00a7 35, stk. 2. E havde alene baseret sit krav p\u00e5 delmaterialerne bitumen og naturgas, som indgik i det f\u00e6rdige materiale asfalt.<\/p>\n<p>Voldgiftsretten bem\u00e6rkede, at det i bet\u00e6nkningen om bestemmelsen AB 18 \u00a7 35, stk. 4, er anf\u00f8rt: \u201d<em>Ekstraordin\u00e6re prisstigninger p\u00e5 dele af et materiale giver ikke ret til godtg\u00f8relse, hvis stigningen ikke er sl\u00e5et igennem i prisen p\u00e5 selve materialet i et s\u00e5dant omfang, at betingelserne for godtg\u00f8relse er opfyldt. Der kan s\u00e5ledes alene opn\u00e5s godtg\u00f8relse for prisstigninger i det omfang, prisstigningerne sl\u00e5r igennem p\u00e5 materialer i den form, hvori de indg\u00e5r i byggeriet eller anl\u00e6gget og ikke delmaterialer isoleret som f.eks. bitumen og cement.<\/em>\u201d<\/p>\n<p>Voldgiftsretten fandt p\u00e5 den baggrund, at det er det i parternes entrepriseaftale f\u00e6rdige materiale asfalt, som \u201d<em>i f\u00e6rdig form eller p\u00e5 s\u00e6dvanlig vis indg\u00e5r i arbejdet<\/em>\u201d, jf. AB 18 \u00a7 35, stk. 2.<\/p>\n<p>E havde godtgjort ekstraordin\u00e6re prisstigninger p\u00e5 bitumen og naturgas, men ikke det f\u00e6rdige materiale asfalt. Voldgiftsretten fandt s\u00e5ledes, at E ikke havde godtgjort, at der forekom en ekstraordin\u00e6r prisstigning p\u00e5 asfalt, hvorfor E ikke kunne begrunde et krav om godtg\u00f8relse, jf. AB 18 \u00a7 35, stk. 2-5.<br \/>\n\u200d<\/p>\n<p><strong>Hvad kan udledes af afg\u00f8relsen?<\/strong>\u200d<\/p>\n<p>Afg\u00f8relsen illustrerer, hvad der forst\u00e5s ved \u201d<em>i f\u00e6rdig form<\/em>\u201d, og udpensler hvilke beviskrav, der g\u00e6lder for godtg\u00f8relse for ekstraordin\u00e6re prisstigninger efter AB 18 \u00a7 35, stk. 2.<br \/>\n\u200d<\/p>\n<p><strong>\u00d8vrige afg\u00f8relser<\/strong>\u200d<\/p>\n<p>TBB har i denne m\u00e5ned ikke udgivet nye afg\u00f8relser.<\/p>\n<p>\u200d<\/p>\n<h4>Nyheder fra branchen<\/h4>\n<p><strong>M\u00e5nedens fokus: Nyt bygningsdirektiv: Energy Performance of Buildings Directive 2024<\/strong>\u200d<\/p>\n<p>Den 12. marts 2024 stemte Europa-Parlamentet et nyt bygningsdirektiv igennem, som skal sikre en dekarboniseret og energieffektiv bygningsmasse inden 2050.<\/p>\n<p>Bygninger er den st\u00f8rste energiforbruger i EU. Det h\u00e6nger sammen med, at 85 % af EU\u2019s bygninger er bygget f\u00f8r 2000, og 75 % af disse bygninger har en d\u00e5rlig energiydelse. Det er derfor n\u00f8dvendigt at optimere bygningers energieffektivitet for at opn\u00e5 den for 2050 fastsatte m\u00e5ls\u00e6tning om en klimaneutral byggesektor.<\/p>\n<p>Bygningsdirektivet vil \u00f8ge renovationsraten for s\u00e6rligt de bygninger, der har den d\u00e5rligste energiydelse. Direktivet skal desuden medvirke til bedre luftkvalitet, digitalisering af energisystemer for bygninger og udrulning af infrastruktur til b\u00e6redygtig mobilitet.<\/p>\n<p>Bygningsdirektivet tillader, at hver medlemsstat vedtager de renovationsforanstaltninger, som passer bedst til medlemslandet. Der er s\u00e5ledes mulighed for at undtage forskellige kategorier af bygninger, herunder historiske bygninger og feriehuse.<\/p>\n<p>Helt konkret fasts\u00e6tter bygningsdirektivet en m\u00e5ls\u00e6tning om, at den samlede bygningsmasse i beboelsesejendomme i gennemsnit skal reducere energiforbruget med 16 % inden 2030 og med 20-22 % inden 2035.<\/p>\n<p>Hvad ang\u00e5r bygninger, som anvendes til andre form\u00e5l end beboelse, skal de d\u00e5rligste 16 % af bygningsmassen forbedre energistandarden inden 2030 og 26 % inden 2033.<\/p>\n<p>Endvidere skal det senest i 2040 v\u00e6re udfaset at anvende fossile br\u00e6ndsler i den individuelle opvarmning, og alle nyopf\u00f8rte bygninger skal s\u00e5ledes v\u00e6re nulemissionsbygninger. Dette tr\u00e6der i kraft den 1. januar 2028 for offentligt ejede bygninger og den 1. januar 2030 for alle andre bygninger.<\/p>\n<p>Udover at bygningsdirektivet forbedrer bygningers energim\u00e6ssige ydeevne, reduceres energiregningerne ogs\u00e5 og g\u00f8r s\u00e5ledes EU mere uafh\u00e6ngig af energikilder.
