C-15924 \u2013 Afsagt den 4. marts 2024<\/h3>\n<p>M\u00e5nedens afg\u00f8relse vedr\u00f8rer en tvist mellem en bygherre og en garant om, hvorvidt garantens nedskrivning af entrepren\u00f8rgarantien fra 10 % til 2 % var berettiget.<\/p>\n<p>\u200d<\/p>\n<p><strong>Resume<\/strong><\/p>\n<p>Bygherre (BH) og entrepren\u00f8r (E) indgik den 21. juni 2016 en entreprisekontrakt, hvor AB 92 var vedtaget. I den forbindelse udstedte pengeinstitut (P) p\u00e5 vegne af E en entrepren\u00f8rgaranti i henhold til AB 92 \u00a7 6.<br \/>\n\u200d<\/p>\n<p>Af garantidokumentet fremgik det, at garantien skulle nedskrives til 10 % af entreprisesummen svarende til 699.293,10 kr. ved aflevering og til 2 % af entreprisesummen svarende til 139.858,62 kr. et \u00e5r efter afleveringstidspunktet, medmindre BH skriftligt havde fremsat krav om afhj\u00e6lpning af mangler over for b\u00e5de E og P. I s\u00e5 fald ville garantien f\u00f8rst blive nedskrevet, n\u00e5r manglerne var afhjulpet.<\/p>\n<p>\u200d<br \/>\nEfter der p\u00e5 afleveringsforretningen den 17. juli 2017 blev konstateret en r\u00e6kke mangler, overtog garant (G) den 13. december 2017 entrepren\u00f8rgarantien. Efter yderligere konstatering af mangler og en langsommelig afhj\u00e6lpningsperiode, som p\u00e5 dav\u00e6rende tidspunkt endnu ikke var afsluttet, nedskrev G den 1. marts 2019 entrepren\u00f8rgarantien fra 10 % til 2 %.<\/p>\n<p>\u200d<br \/>\nDen 23. april 2021 blev E erkl\u00e6ret konkurs, og den 23. september 2021 udbetalte G 139.858,62 kr. til BH svarede til 2 % af entreprisesummen.<\/p>\n<p>\u200d<br \/>\nBH bestred, at garantien var nedskrevet fra 10 % til 2 %, og anlagde sag ved Voldgiftsn\u00e6vnet for Bygge- og Anl\u00e6gsvirksomhed med p\u00e5stand om krav p\u00e5 udbetaling svarende til 10 % af entreprisesummen fratrukket det allerede udbetalte bel\u00f8b p\u00e5 2 % af entreprisesummen.<\/p>\n<p>\u200d<br \/>\nG gjorde g\u00e6ldende, at nedskrivningen fra 10 % til 2 % var berettiget, og nedlagde p\u00e5stand om frifindelse.<\/p>\n<p>\u200d<br \/>\nVoldgiftsretten bem\u00e6rkede, at \u201d<em>G var fuldt bekendt med, at byggeriet var mangelfuldt den 1. marts 2019, hvor banken nedskrev garantisummen [\u2026] Det forhold, at det af afleveringsprotokollen fra 17. juli 2017 fremgik, at manglerne blev vurderet til 75.000 kr. ekskl. moms kan ikke f\u00f8re til et andet resultat, idet det p\u00e5 tidspunktet for nedskrivningen efter den meget forsinkede 1-\u00e5rsgennemgang m\u00e5 have st\u00e5et G klart, at manglerne var langt mere omfattende, end det var antaget ved afleveringen.<\/em>\u201d<\/p>\n<p>\u200d<br \/>\nP\u00e5 den baggrund fandt voldgiftsretten, at nedskrivningen af entrepren\u00f8rgarantien fra 10 % til 2 % var uberettiget, og at garantibel\u00f8bet p\u00e5 699.293,10 kr. svarende til 10 % af entreprisesummen bestod.<\/p>\n<p>\u200d<br \/>\nDa voldgiftsretten efter n\u00e6rmere bevisf\u00f8relse fandt, at BH havde et samlet krav mod G p\u00e5 495.460,97 kr., og da G allerede havde udbetalt 139.858,62 kr. til BH, blev G p\u00e5lagt at betale 355.602,45 kr. til BH.<\/p>\n<p>\u200d<\/p>\n<p><strong>Hvad kan udledes af afg\u00f8relsen?<\/strong><\/p>\n<p>Afg\u00f8relsen illustrerer, at en garant ikke er berettiget til at nedskrive entrepren\u00f8rgarantien fra 10 % til 2 %, n\u00e5r denne er bekendt med, at arbejdet er mangelfuldt.<\/p>\n<p>\u200d<\/p>\n<p><strong>\u00d8vrige afg\u00f8relser<\/strong><\/p>\n<p>TBB har i denne m\u00e5ned ikke udgivet nye afg\u00f8relser.<\/p>\n<p>\u200d<\/p>\n<h4>Nyheder fra branchen<\/h4>\n<p><strong>M\u00e5nedens fokus: M\u00f8de i kontaktudvalget mellem Danske Advokater og Voldgiftsn\u00e6vnet for Bygge- og Anl\u00e6gsvirksomhed den 6. juni 2024<\/strong><\/p>\n<p>\u200d<br \/>\nDen 6. juni 2024 blev det \u00e5rlige m\u00f8de mellem Danske Advokater og Voldgiftsn\u00e6vnet for Bygge- og Anl\u00e6gsvirksomhed afholdt.<\/p>\n<p>\u200d<br \/>\nForm\u00e5let med m\u00f8det var at dr\u00f8fte den generelle h\u00e5ndtering af sager i Voldgiftsn\u00e6vnet for Bygge- og Anl\u00e6gsvirksomhed samt de seneste tendenser og l\u00f8sninger af aktuelle udfordringer.<\/p>\n<p>\u200d<br \/>\nP\u00e5 m\u00f8det oplyste repr\u00e6sentanter for Voldgiftsn\u00e6vnet for Bygge- og Anl\u00e6gsvirksomhed, at de havde arbejdet videre med de gode ideer og \u00f8nsker fra jubil\u00e6umskonferencen i september 2023, og at de i vidt omfang havde fundet vej til n\u00e6vnets handleplan for 2024-2026.<\/p>\n<p>\u200d<br \/>\nP\u00e5 baggrund af m\u00f8dereferatet har vi samlet de ideer og \u00f8nsker, som Voldgiftsn\u00e6vnet for Bygge- og Anl\u00e6gsvirksomhed oplyste at arbejde videre med, herunder de initiativer som forventes fra Voldgiftsn\u00e6vnet for Bygge- og Anl\u00e6gsvirksomhed inden for en overskuelig fremtid:<\/p>\n<p>\u200d<br \/>\nAt Voldgiftsn\u00e6vnet for Bygge- og Anl\u00e6gsvirksomhed i 2024\u2019s andet halv\u00e5r udvider VBA Porta-lens anvendelsesomr\u00e5de, s\u00e5 alle nye sager fremadrettet skal anl\u00e6gges via portalen.<br \/>\nP\u00e5 m\u00f8det oplyste n\u00e6vnet, at de efter sommerferien forventer at v\u00e6re klar til at f\u00e5 alle verse-rende sager p\u00e5 portalen og at stille krav om, at alle nye sager skal anl\u00e6gges via portalen, herunder at de i den forbindelse forventer at f\u00e5 flere af de uhensigtsm\u00e6ssigheder, som parterne oplever i portalen, p\u00e5 plads, inkl. uploadetid, upload af st\u00f8rre filer, flytning af sagsakter mellem mapper, oprettelse af undermapper, mm.<\/p>\n<p>\u200d<br \/>\nAt Voldgiftsn\u00e6vnet for Bygge- og Anl\u00e6gsvirksomhed gennemf\u00f8rer et serviceeftersyn af n\u00e6vnets procesregler fra 2018.<br \/>\nP\u00e5 m\u00f8det oplyste n\u00e6vnte, at de i efter\u00e5ret 2024 vil gennemf\u00f8re et serviceeftersyn af n\u00e6vnets procesregler fra 2018 for at vurdere behovet for justeringer samt eventuelle nye procesregler vedr\u00f8rende AB-forbruger samt projektintegreret voldgift og mediation.<\/p>\n<p>\u200d<br \/>\nAt Voldgiftsn\u00e6vnet for Bygge- og Anl\u00e6gsvirksomhed overvejer at lade sig inspirere af regler og praksis fra de internationale voldgiftsretter.<br \/>\nP\u00e5 m\u00f8det oplyste n\u00e6vnet, at de naturligvis vil lade sig inspirere af international praksis, men at man samtidig skulle v\u00e6re opm\u00e6rksom p\u00e5, at processerne ved de internationale voldgiftsinstitutter kunne opleves mere tunge og komplekse end ved n\u00e6vnet. F\u00f8ring af ekspertvidner i voldgiftssagerne var dog et parameter, hvor n\u00e6vnet s\u00e6rligt ville overveje at lade sig inspirere.<\/p>\n<p>\u200d<br \/>\nAt Voldgiftsn\u00e6vnet for Bygge- og Anl\u00e6gsvirksomhed unders\u00f8ger brugen af AI.<br \/>\nP\u00e5 m\u00f8det oplyste n\u00e6vnet, at de ville unders\u00f8ge brugen af AI n\u00e6rmere, dog alene som et internt hj\u00e6lpemiddel, hvor relevant og sikkert.
