C-16481 \u2013 afsagt den 4. marts 2024<\/h3>\n<p>M\u00e5nedens afg\u00f8relse vedr\u00f8rer en tvist mellem en bygherre og en hovedentrepren\u00f8r om, hvorvidt bygherren havde sikret sig en aftale om fast pris, s\u00e5ledes at hovedentrepren\u00f8ren ikke kunne kr\u00e6ve betaling for prisstigninger.<\/p>\n<p>\u200d<\/p>\n<p><strong>Resume<\/strong><\/p>\n<p>Bygherre (BH) og hovedentrepren\u00f8r (HE) indgik i februar 2021 aftale vedr\u00f8rende udf\u00f8relse af tagudskiftning og etablering af tagboliger inkl. tagterrasser.<\/p>\n<p>Det fremgik af aftalens f\u00e6llesbetingelser under overskriften om tilf\u00f8jelser og fravigelser til AB 18 \u00a7 35, stk. 2, at arbejdet skulle udf\u00f8res til fast pris, og at der ikke skulle foretages indeksregulering af entreprisesummen.<\/p>\n<p>\u200dHE kr\u00e6vede senere betaling for prisstigninger.<\/p>\n<p>\u200dVoldgiftsretten bem\u00e6rkede, \u201d<em>At entreprisesummen er fast, er reguleret i AB 18 \u00a7 34, der ogs\u00e5 vedr\u00f8rer indeksregulering, og som anf\u00f8rt fremg\u00e5r det af selve entreprisekontrakten som en fravigelse af denne bestemmelse, at entreprisesummen ikke skulle indeksreguleres. AB 18 \u00a7 35, stk. 2, ang\u00e5r derimod entrepren\u00f8rens eventuelle godtg\u00f8relse for ekstraordin\u00e6re prisstigninger p\u00e5 materialer.<\/em>\u201d<\/p>\n<p>\u200dVoldgiftsretten fandt derfor, at parternes f\u00e6llesbetingelser p\u00e5 dette punkt var s\u00e5 uklare, at det m\u00e5tte komme koncipisten og dermed BH til skade, og at HE dermed ikke var afsk\u00e5ret fra at rejse krav om godtg\u00f8relse for ekstraordin\u00e6re prisstigninger p\u00e5 materialer, s\u00e5fremt de \u00f8vrige betingelser herfor i AB 18 \u00a7 35, stk. 2, var opfyldt.<\/p>\n<p>\u200dDa HE ikke under sagen havde godtgjort, hvad de respektive materialepriser var p\u00e5 tilbudsdagen, fandtes betingelserne i AB 18 \u00a7 35, stk. 2, dog ikke at v\u00e6re opfyldt, og HE blev alene tilkendt et sk\u00f8nsm\u00e6ssigt bel\u00f8b.<\/p>\n<p>\u200d<\/p>\n<p><strong>Hvad kan udledes af afg\u00f8relsen?<\/strong><\/p>\n<p>Afg\u00f8relsen illustrerer koncipistreglen, hvorefter uklarheder i parternes kontrakt, fortolkes mod koncipisten, som er n\u00e6rmest til at b\u00e6re risikoen for kontraktens uklarheder.<\/p>\n<p>\u200d<\/p>\n<p><strong>\u00d8vrige afg\u00f8relser<\/strong><\/p>\n<p><strong>Garanti<\/strong><\/p>\n<p><a href=\"https:\/\/pro.karnovgroup.dk\/b\/documents\/7000960676\">TBB 2024.687<\/a>\u00a0\u2013 sag nr. C-15924<\/p>\n<p>Nedskrivning af entrepren\u00f8rgaranti fra 10 % til 2 % var uberettiget, da garant havde kendskab til mangler.<\/p>\n<p>\u200d<\/p>\n<p><strong>Mangler<\/strong><\/p>\n<p><a href=\"https:\/\/pro.karnovgroup.dk\/b\/documents\/7000960675\">TBB 2024.704<\/a>\u00a0\u2013 sag nr. C-15732<br \/>\nTotalentrepren\u00f8r blev frifundet for mangler ved linoleumsgulv, da der ikke var beg\u00e5et ansvarsp\u00e5dragende fejl. Dette selvom behovet for reparationer og udskiftninger af svejsninger var v\u00e6sentligt over, hvad der m\u00e5tte forventes.<\/p>\n<p>\u200d<\/p>\n<p><a href=\"https:\/\/pro.karnovgroup.dk\/b\/documents\/7000960674\">TBB 2024.697<\/a>\u00a0&#8211; sag nr. C-15706<br \/>\nHovedentrepren\u00f8r havde ikke s\u00f8gt afklaring hos bygherren vedr\u00f8rende forhold i projektmaterialet, og blev derfor kendt ansvarlig for mangler.<\/p>\n<p>\u200d<\/p>\n<p><strong>Andet<\/strong><\/p>\n<p><a href=\"https:\/\/pro.karnovgroup.dk\/b\/documents\/7000960679\">TBB 2024.723\u00a0<\/a>\u2013 sag nr. C-16139<br \/>\nEn underentrepren\u00f8r havde udf\u00f8rt el-arbejder for en entrepren\u00f8r, hvorefter der opstod tvist mellem parterne om betaling. Derudover sp\u00f8rgsm\u00e5l om bevisbyrde og forrentning.<\/p>\n<p>\u200d<\/p>\n<p><a href=\"https:\/\/pro.karnovgroup.dk\/b\/documents\/7000960678\">TBB 2024.715<\/a>\u00a0\u2013 sag nr. C-16080<br \/>\n\u00d8konomisk opg\u00f8r mellem totalentrepren\u00f8r og to bygherrer som f\u00f8lge af tvist om betaling af fakturaer for kontrakt- og ekstraarbejder samt krav om fradrag og mangler.<\/p>\n<p>\u200d<\/p>\n<p><a href=\"https:\/\/pro.karnovgroup.dk\/b\/documents\/7000960677\">TBB 2024.695<\/a>\u00a0\u2013 sag nr. C-16024<br \/>\nUnderentrepren\u00f8r, der udf\u00f8rte el-arbejde, blev kendt erstatningsansvarlig for skader ved brand, som opstod mere end 1 \u00e5r efter el-arbejdets udf\u00f8relse.<\/p>\n<p>\u200d<\/p>\n<p><a href=\"https:\/\/pro.karnovgroup.dk\/b\/documents\/7000959863\">TBB 2024.647<\/a>\u00a0\u2013 sag BS-15620\/2022-VLR<br \/>\nEntrepren\u00f8r havde p\u00e5taget sig at udf\u00f8re arbejde i regning, men som f\u00f8lge af v\u00e6sentlig overskridelse af overslagsprisen p\u00e5 arbejdet skulle der ske en reduktion af kravet.<\/p>\n<p>\u200d<\/p>\n<p>\u200d<\/p>\n<h4>Nyheder fra branchen<\/h4>\n<p><strong>M\u00e5nedens fokus: Bygherreforeningens guide til at h\u00e5ndtere konkurser<\/strong><\/p>\n<p>\u200d<br \/>\nEntrepren\u00f8rkonkurser er en stor udfordring for bygherrer, som kan medf\u00f8re betydelige konsekvenser for det aktuelle projekt. De seneste \u00e5r er antallet af konkurser i byggebranchen steget, hvorfor Bygherreforeningen har udarbejdet en guide til at h\u00e5ndtere konkurserne bedst muligt.<\/p>\n<p>\u200d<br \/>\nEn konkurs kan ofte komme uforudset, og det er derfor vigtigt at forberede sig med nedskrevne retningslinjer, s\u00e5 man ved, hvilke tiltag der skal iv\u00e6rks\u00e6ttes. Guiden indeholder derfor 10 konkrete r\u00e5d til bygherrens h\u00e5ndtering af konkurser, som best\u00e5r af indsatser f\u00f8r, under og efter konkursen.<\/p>\n<p>\u200d<br \/>\nBlandt andet anbefales det straks at orientere relevante interne og eksterne interessenter om konkursen, standse betalinger til den konkursramte entrepren\u00f8r og sikre byggepladsen.<\/p>\n<p>\u200d<br \/>\nSamtidig anbefales det hurtigt at skabe overblik over stadet ved gennemf\u00f8relse af stadeopg\u00f8relse samt at gennemg\u00e5 aftaler og \u00f8konomi med henblik p\u00e5 at understrege, hvad der g\u00e6lder mellem parterne.
